TERMS OF SERVICE

Governing the Use of the KURAI Platform

PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ACCESSING OR USING THE KURAI PLATFORM. BY CREATING AN ACCOUNT OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS IN FULL.

1. PARTIES AND AGREEMENT

1.1 These Terms of Service (“Terms”) constitute a legally binding agreement between Arson Pixelz (Private) Limited (“Arson Pixelz”, “we”, “us”), a company incorporated under the Companies and Other Business Entities Act [Chapter 24:31] of Zimbabwe (Registration Number: 82248A0122026), and the person accessing or using the KURAI platform (the “User”, “you”).

1.2 Where the User is a learner under the age of 18, these Terms are entered into by, and binding upon, the learner’s parent or legal guardian, who assumes responsibility for the learner’s compliance.

1.3 Access to the Platform is a privilege, not a right. Arson Pixelz reserves the right to suspend, restrict or terminate access at any time for breach of these Terms or for any other lawful reason.

2. THE PLATFORM

2.1 KURAI is an artificial intelligence-powered educational platform providing ZIMSEC-curriculum-aligned academic support for secondary school learners preparing for O-Level and A-Level examinations.

2.2 The Platform is provided on an “as is” and “as available” basis. Arson Pixelz does not guarantee that the Platform will be available at all times, free from errors or interruptions.

2.3 AI-generated responses are designed to be accurate and curriculum-aligned but are not guaranteed to be correct in all cases. Users must verify important information against authoritative sources such as ZIMSEC syllabuses, textbooks, and teachers.

3. ELIGIBILITY AND REGISTRATION

3.1 The Platform is intended for use by secondary school learners, teachers, and school administrators in Zimbabwe. Adult users (18 years and over) may register directly. Learners under 18 may only register and access the Platform after their parent or legal guardian has provided explicit written consent in terms of section 26 of the Cyber and Data Protection Act [Chapter 12:07].

3.2 You must provide accurate, complete and truthful information when creating your account. You must promptly update your account information if it changes.

3.3 You are responsible for maintaining the confidentiality of your account credentials. You must not share your username or password with any other person. You are responsible for all activity that occurs under your account.

4. PERMITTED USE

You may use the Platform solely for lawful, personal, non-commercial educational purposes. Permitted uses include asking academic questions aligned with your ZIMSEC subjects, reviewing worked examples and practice questions, preparing for ZIMSEC examinations, and accessing educational resources available on the Platform.

5. PROHIBITED USE

You must not use the Platform to:

  • (a) submit AI-generated content as your own original work in any school assignment, assessment, or ZIMSEC examination (academic fraud);
  • (b) manipulate, “jailbreak”, or attempt to circumvent the AI safety systems or content filters;
  • (c) generate, distribute or access content that is harmful, illegal, sexually explicit, violent, hateful, discriminatory, or defamatory;
  • (d) attempt to gain unauthorised access to any other account, system, or network;
  • (e) introduce malicious code, viruses, or disruptive software into the Platform;
  • (f) reverse-engineer, decompile, copy, or reproduce any part of the Platform, its AI models, software, or content;
  • (g) use the Platform for any commercial purpose, including reselling, sublicensing, or distributing AI-generated content;
  • (h) use automated tools, bots, or scripts to access the Platform other than as intended for individual human use; or
  • (i) harass, impersonate, or intimidate any other user or member of the Arson Pixelz team.

6. INTELLECTUAL PROPERTY

6.1 All intellectual property rights in the Platform, including its software, AI models, training data, algorithms, curriculum content, branding, and the KURAI name and marks, are owned by or licensed to Arson Pixelz (Private) Limited. Nothing in these Terms transfers any intellectual property rights to you.

6.2 Arson Pixelz grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for the purposes permitted under these Terms. This licence does not include any right to copy, modify, distribute, or create derivative works from any Platform content.

6.3 AI-generated responses provided to you through the Platform remain the property of Arson Pixelz. You may use them for your personal educational purposes only and may not reproduce, publish, or distribute them.

7. PRIVACY AND DATA PROTECTION

Your use of the Platform is subject to our Privacy Policy and Cookie Policy, which form part of these Terms. By using the Platform, you acknowledge that you have read and accepted those policies. Our Privacy Policy is available at https://arsonpixelz.com.

8. DISCLAIMERS AND LIMITATION OF LIABILITY

8.1 The Platform is provided for educational support purposes only. AI-generated content is not professional advice of any kind and should not be relied upon as a substitute for qualified educational, medical, legal, or financial advice.

8.2 To the maximum extent permitted by Zimbabwean law, Arson Pixelz excludes all implied warranties and conditions in respect of the Platform.

8.3 Arson Pixelz’s total liability to you in respect of any loss or damage arising from your use of the Platform shall not exceed the total fees paid by you for access to the Platform in the twelve months preceding the claim, or USD 100 (whichever is less). Where the Platform is provided free of charge, our liability is limited to USD 100.

8.4 Nothing in these Terms limits Arson Pixelz’s liability for death or personal injury caused by its negligence, or for any liability that cannot be excluded by law.

9. TERMINATION AND SUSPENSION

9.1 Arson Pixelz may suspend or terminate your access to the Platform immediately and without notice if you breach any provision of these Terms, engage in conduct that Arson Pixelz reasonably considers harmful, illegal or inappropriate, or if required to do so by law or a competent authority.

9.2 You may terminate your account at any time by contacting support@arsonpixelz.com. Upon termination, your personal data will be handled in accordance with our Privacy Policy.

10. GOVERNING LAW AND DISPUTE RESOLUTION

10.1 These Terms are governed by and construed in accordance with the laws of Zimbabwe.

10.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.

11. GENERAL

11.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force.

11.2 Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.

11.3 We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Platform. Continued use after notification constitutes acceptance of the updated Terms.
